Ask by Company to leave Cos of Pregnancy Complications

Hi Joanna

Did you speak to the MOM officer? Last year, my HR said that my hospitalisation before childbirth is considered as maternity leave and said its according to Employment Act.

I was doubtful and call MOM, they said no and after some calls and emails, my HR then give me back my ML

Hi Joanna

Must take care of yourself and dont be frustrated too much as bad for you n baby.

Call the MOM and tell them your situation. According to MCYS, ML is given to all singaporean women who meet the three criteria. it shouldnt depend on whether you are under employment act or no.

Joanna, i'm really sorry to hear about your plight. sad to say, some MOM officers don't know what they're talking about.

tuete is right, look at the Child Development Co-Savings Act. It applies to all female employees who meet the criteria.

“employee” means any person who has entered into or works under a contract of service with an employer in Singapore, and includes a workman and any officer or employee of the Government

please keep us updated of your correspondence with PM Lee. I think too many ladies are in similar positions as you, and it is just not right.

Joanna, on further reading, i think your former employer is really a sneaky b***h. the letter of the law may not help you (because it seems you need to be less than 3 months before EDD). but i think many will sympathise with your situation. the law needs to change because the distinction is artificial.

I check futher. Excludes civil servants. As long 6 months frm due date can claim. Depends on the officer that is fighting for u. Mine considered termination. But just feel it is really unfair.and I am working for the charity arm of the Govt. They should understand even better the financial difficulty.

I am sorry to hear about your case. It seems terribly unfair. I hope you have worked long enough to have at least gone through one performance review. What I know is that when cases gets the spotlight, if you have received any performance bonus at all, it means that you have been doing your job well.

Each employee (civil servant or not) should be entitled to sick time and hospitalisation leave, etc. So what, if a guy breaks his leg and needs to recuperate for 3 months, they sack him as well? There is always what the law says, and then there is what common decency and courtesy says.

Can you PM me which agency you work for? I am curious, and in my experience, sometimes the really big bosses doesn't know what their boys and girls are doing behind their back. My colleagues and I were almost unfairly terminated once, with the advice from the Chief HR no less! And then I got really angry and I wrote to the President of the organisation (around midnight!) and told him what a crap job he is doing if his guys are trying to get rid of us all, each of us were there because we were requested to join (not open interviews!). And then I told him that to him, we are just a faceless line-item on the payroll - but like him, we are living, breathing people - people that actually loved our jobs and want to make an honest living! And then I told him that we have mortgages and bills to pay. And then I wished him the best in his Presidency - maybe he will turn out better than us (he's also on the payroll, lah!).

Our phones started ringing off the hook from 8am - the long and short of the story is that none of us were asked to leave.

In the grand scheme of things, unless you have been getting a lot of nudges even before all these MCs occured, a termination is definitely untimely and politically wrong. I hope you told PM where you work so that he can go and "ketuk" someone! Alternatively, you should consider letting your boss' boss know. But you need to get the language and tone just right - else it goes to recycle bin!

Good luck, and do update!!

I am working for the charity arm of the govt. i thought being a charity arm of the govt, they will understand my plight more than other companies. I have Only started work in May 12. I wasn't late for work, did all that was asked, no warning letter or anything... so the only excuse My director could use was that the department closing down and no vacancy anywhere for me. She is a lot smarter than Head of HR, who was using My pregnancy complications to get to me resign.

I suppose someone hasn't heard that "Charity begins at home!!" Anyway, the important thing is that HR did seek you out and asked you to resign because of your pregnancy complications. Wrong move #1. And then, wrong move #2 is that they terminated you. What horrible people! Anyway, are you serving your notice period now? My advice is that you should start looking for a job on the side, cos you probably won't wanna see those faces anymore! My ex-boss once said, that we cannot ask any pregnant person to leave because it's just unfair, and politically wrong. It's like striking when you know they are disadvantaged to fight back. Even though sometimes, we do have legal rights!

For my #2, I discovered I was (finally!) expecting a week after being on the job! My then boss' response was "Oh, my... congratulations!! So we have ?? mths to find extra help". A friend of mine started a new job when she was 5 months' pregnant! So, there you go... there's hope, and there are very good colleagues and bosses. Your mission is to find them!

hi all, just saw the thread. I just got pregnecy too. My company are undergoing retrenchment as well. I have drop PM Lee a private msg on FB but guess what no reply at all. I do not know when my head will be chop and I have not told my pregency just so worry they will find excuses.

Me too, my boss let me work till the last day before I start my maternity leave, he say wan to terminate me due to my mc and leave during pregnancy... So sad, he didn't even pay me one shot and pay by installment, I talk to him for very long and even call mom then he willing to pay me 4 mths maternity leave and 1 mth notice... At first he only plan to pay me 4 mths only...
